====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 12-01-2021 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 447, 504, 506 of the Indian Penal Code, Sections 27 and 30 of the Arms Act.

According to FIR, three persons including the petitioners allegedly fired at the informant causing injury near the chest. The Doctor has found two lacerated wound at the right chest caused by firearm injury.

Learned counsel for the petitioner submits that for land dispute, there is case and counter case. Petitioners had also sustained injury during the course of occurrence which the prosecution has suppressed in the FIR. Petitioners are in custody since 22.05.2020.

Patna High Court CR. MISC. No.29567 of 2020(3) dt.12-01-2021 2/2 Investigation of the case against the petitioners is already complete. Considering the facts aforesaid especially the fact that the medical report does not support the allegation of firing by three persons and completion of investigation against the petitioners as well as there is no material to substantiate that the petitioners are going to tamper with the evidence, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ramgarh (Nuaon) Police Station Case No. 103 of 2020, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.

(c) The petitioners shall not leave the country without permission of the court.
