The petitioner seeks regular bail in connection with Ramgarh P.S. Case No. 29 of 2023, registered for the offence punishable under Section 376 of the Indian Penal Code and Section 3 / 4 of the Dowry Prohibition Act.
The allegation against the petitioner is that he made physical relation with the informant for about three years in pretext of marriage.
Learned counsel for the petitioner submits that there was consensual relationship between the informant and the petitioner and Section 376 does not make out in this case. He further submits that for pressurising the petitioner to marry the complainant/informant the case was lodged. However, the
Patna High Court CR. MISC. No.30846 of 2023(2) dt.15-06-2023 2/2 petitioner has married with the informant and living happy matrimonial life. Petitioner has himself surrendered before the Court concerned on 24.02.2023 and he is in judicial custody since then. There is no criminal antecedent against the petitioner.
Learned APP for the State has opposed the prayer for regular bail of the petitioner.
Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate - 1st class, Mohania in connection with Ramgarh P.S. case No.- 29 of 2023.
