====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 02-08-2024 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner is apprehending his arrest in connection with Guthani P.S. Case No. 13 of 2020 dated 10.01.2020 registered for the offences punishable under Sections 447 and 392/34 of the I.P.C.

3. As per the prosecution case, three unknown miscreants boarded on the Apache Motorcycle came to the CSP Centre, Canara Bank of the informant and snatched Rs. 1,10,000/- on the point of arms and they fled away.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.34483 of 2024(2) dt.02-08-2024 2/3 that the petitioner is innocent and has been falsely implicated in this case. The petitioner is not named in the F.I.R. His name has come in the present case on the basis of the confessional statement of the co-accused Vishal Singh which has got no evidentiary value in the eye of law. No incriminating article has been recovered from the possession of the petitioner. The other co-accused Kaushik Ram @ Kaushik Kumar has already been granted bail by a Bench of this Court vide Cr. Misc. No. 9778 of 2024 under order dated 28.02.2024, annexed as Annexure-P/2 to the present bail application. The petitioner has one criminal antecedent in which he is on bail as stated in paragraph no. 3 of the bail application.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIII, Siwan in connection with Guthani P.S. Case No. 13 of 2020, subject to the condition as laid down under Section 438(2) of the Code of
