2. The present modification application has been filed for modification of the order dated 02.04.2025 passed in Cr. Misc. No. 17285 of 2025 by which the petitioners have withdrawn the bail application with respect to petitioner no. 1.

3. Learned counsel for the petitioners submits that due to inadvertence petitioners have withdrawn the bail application with respect to petitioner no. 1 in place of petitioner no. 2 and the Hon'ble Court has been pleased to grant permission to withdraw the bail application with respect to petitioner no. 2

Patna High Court CR. MISC. No.29703 of 2025(2) dt.02-05-2025 2/2 with liberty to file a fresh application.

4. Learned counsel for the petitioners further submits that in paragraph-3 of the order dated 02.04.2025 was recorded that the bail petition of petitioner no. 2 was withdrawn with liberty to file a fresh application but it should be recorded as the bail petition of petitioner no. 1 be withdrawn, as he was not arrested, with liberty to file a fresh application.

5. In this view of the matter, the order dated 02.04.2025 is modified to the extent that the bail application of petitioner no. 2 be deemed to be withdrawn as she was arrested and the bail application of petitioner no. 1 is concerned, he is granted to withdraw the application with liberty to file a fresh application.

6. With the aforesaid, the modification application stands disposed.
