The petitioner is apprehending his arrest in connection with Rajauli P.S.Cae No.89 of 2018 registered for offences punishable under Sections 341, 386, 504,506/34 of the Indian Penal Code. Allegation against the petitioner is of demanding Rangdari from the informant and further the petitioner is accused in two other cases.

Submission of the learned counsel for the petitioner is that earlier lodging the present case, the petitioner had lodged a case against the informant for engaging in illegal trade of sand due to that the present case has been lodged against the petitioner. Heard learned A.P.P. also, who has opposed the prayer for bail.

Patna High Court Cr.Misc. No.46039 of 2018 (2) dt.09-08-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
