The petitioner seeks bail in Bihpur P.S. Case No. 188 of 2018, instituted for the offence under Section(s) 364, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioner submits that during investigation, the victim was recovered on the same day from the Maize field. The Police did not record the statement of victim on the same day of his recovery rather his statement under Section 164 Cr. P.C. has been recorded on 16.5.2018. Mere suspicion has been raised against the petitioner of kidnapping the cousin brother of the informant. He further submits that co-accused Malu Paswan @ Mallu Paswan @
Patna High Court CR. MISC. No.38476 of 2019(3) dt.29-07-2019 2/2 Malho Paswan has already been granted bail by coordinate Bench of this Court vide order dated 8.3.2019 passed in Cr. Misc. 14493 of 2019.
Petitioner is in custody since 6.6.2018.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Naugachia, in the District of Bhagalpur, in connection with Bihpur P.S.
