The petitioner is languishing in custody in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
As per the prosecution case, five miscreants looted a cash box containing Rs. 1,00,456/-, a mobile phone and the other important documents from the informant's petrol pump on the point of pistol.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R and his name subsequently sprang up on the confessional statement of coaccused Munna Yadav. Nothing has been recovered from the
Patna High Court CR. MISC. No.33016 of 2023(2) dt.24-06-2023 2/2 conscious possession of the petitioner. The petitioner has still not been put on T.I.P. The petitioner is languishing in custody since 13.12.2022. Similarly situated other accused person has already been enlarged on bail by this Court vide order dated 17.05.2023 passed in Cr. Misc. No. 18850 of 2023. Learned APP appearing for the State has opposed the prayer of Bail.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar in connection with Daudnagar P.S. Case No. 680 of 2022.
