JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-11-2022 Heard learned counsel for the appellant, informant and learned Special P.P for the State. The appellant has challenged the order dated 22.04.2022 passed by learned Additional District & Sessions Judge-I, Jamui in connection with Jamui P.S. Case No. 88 of 2022 instituted for the offences punishable under Section 302 of the Indian Penal Code and Sections 3(ii)(v) of the SC & ST (Prevention of Atrocities) Act, whereby his prayer for being released on anticipatory bail has been rejected.

It is a case of commission of murder of the

Patna High Court CR. APP (SJ) No.1870 of 2022(3) dt.10-11-2022 2/3 husband of the informant.

It is submitted by learned counsel for the appellant that appellant has falsely been implicated in this case. The appellant is not named in the F.I.R and his name subsequently sprang up on the confessional statement of co-accused Subhash Das. There is no direct evidence against the appellant. The informant is not an eye witness to the occurrence. A statement has been made in para 3 of the petition that appellant has no criminal antecedent.

Taking into account the aforesaid facts, this Court deems it appropriate to set aside the order dated 22.04.2022 passed by learned Additional District & Sessions Judge-I, Jamui in connection with Jamui P.S. Case No. 88 of 2022.

Accordingly, this appeal is allowed.

The appellant, above named, is directed to be released on bail in the event of his arrest or surrender within a period of four weeks from today and on his

Patna High Court CR. APP (SJ) No.1870 of 2022(3) dt.10-11-2022 3/3 furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-I, Jamui in connection with Jamui P.S. Case No. 88 of 2022.
