2. Petitioner seeks regular bail in connection with Sangrampur P. S. Case No. 326 of 2025 registered for the offences punishable under Sections 103(1), 61(2), 111 and 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. As per prosecution case, all 14 F.I.R. named accused persons, including this petitioner, are alleged to have killed husband of informant, namely Dhananjay Giri and one Guddu Yadav, by firing gun shot.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. From bare perusal of the F.I.R. it is apparent that informant is not an eye

Even as per prosecution case, all 14 F.I.R. named accused persons, including this petitioner, are alleged to have made indiscriminate firing as a result husband of informant, namely, Dhananjay Giri sustained two firearms injuries whereas Guddu Yadav sustained one firearms injury, however, it is not specific that whose fire hit the deceased persons. Moreover, charge-sheet has already been submitted and petitioner is in custody since 07.10.2025.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, period of custody and the fact that charge-sheet has been submitted, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Sadar, Motihari in connection with Sangrampur P. S. Case No. 326 of 2025.
