In this case, the petitioners are apprehending their arrest in connection with Ziradei P.S. Case No. 20 of 2019 registered for offences under sections 447, 323, 504, 353, 34 of the Indian Penal Code.

As per allegation made in the First Information Report, the petitioners came to the office of the Informant and coerced him to commit wrong, when he refused for the same, they assaulted him with Halmet. On hulla, they fled away leaving behind the motorcycle.

Learned counsel for the petitioners submits that the Informant has not treated himself on account of non-receiving

Patna High Court CR. MISC. No.29598 of 2019(2) dt.06-05-2019 2/2 of the injury and that the place of occurrence was not a office rather it is a residence. He has further submitted that Section 447 I.P.C. is bailable and Section 353 I.P.C. is not available in the present case.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioners.

Accordingly, the prayer for anticipatory bail of the petitioners, above named, is rejected.

If the petitioners surrender before the court below within a period of three weeks from today and make a prayer for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law on the same day of their appearance.
