1. The petitioner preferred this writ petition praying for granting of benefit of A.C.P. Scale and refix pension w.e.f. 01.05.2008, as she retired on 30.04.2008.

2. The respondents have filed a counter stating that the petitioner was employee of the School, which has been taken over by the Government. The benefit of A.C.P. was not available to her and the Bihar Taken Over Elementary School Teachers' Promotion Rules, 1993 would apply for the purpose of granting of the Matric Trained Senior Scale. It is further stated that the claim of the petitioner would be considered and benefit should be granted accordingly.

3. If, it is found that she is entitled for the same, taking note of the counter, this Court deems it appropriate to close the proceedings in terms of the assurance given by the respondents.
