JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-07-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Dulhin Bazar P.S. Case No.82 of 2015 registered under Sections 341, 323, 354 and 504 of the Indian Penal Code. It is submitted that the informant and his family members assaulted the petitioners on the same day as a result of which petitioner no.1 received injury over his head and on his application Dulhin Bazar P.S. Case No.84 of 2015 was registered against the informant of this case. It is further submitted that the petitioners are full brother and are aged about 26 years and 22 years respectively and it is beyond imagination that they would jointly

Patna High Court Cr.Misc. No.43109 of 2018 (2) dt.20-07-2018 2/2 misbehaved with the daughter of the informant. As a matter of fact, in order to save his own skin, the informant has lodged a false case against the petitioners, who are having no criminal antecedent.

Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners.

Regard being had to the nature of allegation and the submissions made on behalf of the petitioners, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge-cum-Special Judge, POCSO, Patna in connection with Dulhin Bazar P.S. Case No.82 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
