2. The petitioner is in custody in a case registered for the offence punishable under Sections 304(B), 201 and 120(B) of the Indian Penal Code.
3. As per allegation in the FIR, it is a case dowry death of the deceased due to non-fulfilment of dowry demand by the petitioner and his family members.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the petitioner is the husband of the deceased and he is in custody since 06.01.2024.
5. Learned APP for the State as well as the Informant
Patna High Court CR. MISC. No.32978 of 2024(3) dt.21-06-2024 2/2 opposes the prayer for bail of the petitioner.
6. On perusal of the first information report, case diary and postmortem report of the decreased, it appears that on 27.12.2023, the petitioner informed the informant about missing of the deceased and the next day, her dead body was recovered from a railway track and the allegation against the petitioner is that he along with his family members murdered the deceased and disposed her body and her dead body was found in mutilated condition on a railway track and their marriage was solemnized within seven years of the incident, considering which, I am not inclined to grant bail to the petitioner.
7. Prayer for bail of the petitioner is hereby rejected.
8. The trial Court is directed to expedite the trial as early as possible.
