Mr.Ramchandra Sahni ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 02-05-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Sasaram Town (Model) P.S. Case No. 1267/2018, instituted for offences under Section(s) 420, 468, 471/34 of the Indian Penal Code. The instant case has been lodged at the instance of local MLA.

It is alleged in the written report that on the date of occurrence there was some altercation between the parties for which Darigaon P.S. Case No. 1928/2017 was lodged by petitioner no. 1 against the informant of the instant case. It is alleged that injured of the said case, namely, Rabindra Singh,

Patna High Court CR. MISC. No.28789 of 2019(2) dt.02-05-2019 2/2 was treated at Sadar Hospital, Sasaram by Dr. Sidheshwar Prasad, who issued injury report as simple on the basis of X-ray report. It is further alleged that these petitioners in connivance of doctor and other staff got a forged C.T. Scan report from P.M.C.H., Patna of the injured of aforesaid case showing injury no. 1 as grievous.

Learned counsel for the petitioners has submitted that petitioners have not committed any fraud. They have no role in making injury report.

Petitioners are in custody since 17.03.2019. Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram Town (Model) P.S. Case No. 1267/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
