Petitioner seeks bail in Majorganj P.S. Case No.06 of 2020 registered under Sections 08/20 (b) (ii) (B) of the NDPS Act.
The informant (SSB Officer) got information about smuggling of ganja from a motorcycle. On such information, the informant intercepted a motorcycle and found two persons coming on that motorcycle. Both persons were apprehended and 1.6 kg ganja was recovered from both the accused. It is submitted that the petitioner has got no criminal antecedent and the petitioner is in custody since 07.01.2020. The petitioner has already remained in jail for more than one year. Similarly situated co-accused Prince Kumar has already been granted bail vide order dated 13.10.2020 passed in
Patna High Court CR. MISC. No.31077 of 2020(2) dt.25-01-2021 2/2 Cr.Misc.No.26064 of 2020 by a coordinate bench of this Court. Taking into consideration the fact that 1.6 kg ganja was recovered from two accused persons including the petitioner and one of the accused, namely, Prince Kumar has already been granted bail and the petitioner has remained in jail for more than one year, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Sitamarhi in connection with Majorganj P.S.
