JUSTICE SHIVAJI PANDEY ORAL ORDER 19-07-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.
The petitioner apprehends his arrest in Nawada P.S. Case No.146 of 2018 registered under Sections 414, 419, 420/34 of the Indian Penal Code.
The allegation has been made in the FIR that the police party conducting checking Hero Honda splendor and it was found that the registration number of front side and back side was different. The said motorcycle was recovered from the possession of Radheyshyam Chaudhary but he told that he has purchased the said motorcycle from Dipu. During the course of investigation, it was also revealed that Nitesh Kumar and Anuj Kumar are also involved in selling the purchasing of motorcycle. The learned counsel for the petitioner submits that since
Patna High Court Cr.Misc. No.43178 of 2018 (2) dt.19-07-2018 2/2 later on it was found that this was the stolen motorcycle and the person arrested has disclosed the name of the petitioner. One Nitish Kumar has already been granted bail in Cr. Misc. No.36756 of 2018.
Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Hence the prayer for bail is rejected. However, if the petitioner surrender before the Court below and prays for regular bail, the Court below will take to cognizance of the order passed in the case of Radheshayam and Nitish Kumar.
