JUSTICE SHIVAJI PANDEY ORAL ORDER 19-07-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Adapur (Harpur) P.S. Case No.03 of 2018 registered under Sections 420, 406, 467, 468, 471, 323, 504, 506/511 of the Indian Penal Code on the basis of Complaint Case No.381 of 2017 referred under Section 156 (3) of the Cr.P.C.. The allegation has been made that the petitioner was volunteer of Gyani Shah Warasi. Baba Gyani Shah Warasi was religious Guru of Muslim community and he was living in Gaya. It has further been alleged that Gyani Shah Warasi had gone to the place in which after death of Baba, his Mazar will be established. Baba Warsi died and his Mazar was established in the land of the petitioner. The petitioner started earning from the offer given by
Patna High Court Cr.Misc. No.43145 of 2018 (2) dt.19-07-2018 2/2 the person who come in Mazar. Allegation has been made that in spite of the depositing the amount in bank, the petitioner himself consuming the same. It is completely a money dispute. Considering the facts aforesaid facts and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul, East Champaran at Motihari, in connection with Adapur (Harpur) P.S. Case No.03 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
