The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 302 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegedly, it is a case of commission of murder of the son of the informant by the petitioner along with other accused persons.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is no material against the petitioner and no eye witness, as alleged in the FIR and the petitioner has been implicated in this case only on the basis of suspicion.

Patna High Court CR. MISC. No.31089 of 2022(3) dt.13-12-2022 2/2 However, learned APP for the State has opposed the prayer for anticipatory bail of the petitioner and submitted that the petitioner is named in the FIR.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Uchkagaon P.S. Case No. 207 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
