For direction upon the respondent Bihar Police Sub-Ordinate Service Commission to publish the date of physical efficiency test afresh pursuant to Advt. no. 02/2019 for those candidates whose request for giving an

Patna High Court CWJC No.12672 of 2021(2) dt.30-11-2023 2/3 opportunity of physical efficiency test was accepted by the Commission but without taking physical efficiency test of those such candidates, the process of recruitment has been stopped arbitrarily.

(ii). For direction upon the respondent Bihar Police Sub-Ordinate Service Commission to allow the petitioners who had similarly made request for extension of the date of physical efficiency test in view of medical report as per announcement made by the commission at the centre of physical efficiency test i.e. Shaheed Rajendra Prasad Singh Rajkiye Uchh Vidyalaya (Patna High School), Gardnibagh, Patna on their respective date of physical efficiency test (PET). (iii). For commanding the respondent Bihar Police Sub-Ordinate Service Commission to publish the final result only after taking physical efficiency test of the petitioner.

(iv). The respondents Bihar Police Sub-Ordinate Service Commission may be restrained from publishing the final result of the post of subInspector of Police, sergeant, ASJ (Direct) pursuant to Advt. No.01/2019 during pendency of the writ petition."

At the outset, the learned counsel for the petitioner submits that though the present writ petition has been rendered infructuous with the passage of time, however, he be granted
