The petitioner seeks bail in Madhepur P.S. Case No. 17/2019, G.R. No. 141/2019, instituted for offences under Section(s) 429 and 295(A) of the Indian Penal Code. It is alleged in the written report that on the date of occurrence one boy was going on his bicycle with a calf, containing meat in a plastic bag on his bicycle. On interrogation he fled away leaving his bicycle. It is further alleged that aforesaid meat was of any big animal.

Learned counsel for the petitioner has submitted that petitioner was not apprehended on the spot. He has been arrested by the police during investigation on the basis of suspicion.

Patna High Court CR. MISC. No.30659 of 2019(2) dt.09-05-2019 2/2 From the written report itself it appears that petitioner was not arrested on the spot. There is no recovery of any incriminating article from possession of this petitioner. Petitioner is in custody since 28.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jhanjharpur, in connection with Madhepur P.S. Case No. 17/2019, G.R. No. 141/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
