Petitioner apprehends his arrest in connection with Madhepur P.S. Case No. 25 of 2019 registered for the offence punishable under Sections 448, 353, 427, 147 and 500 of the Indian Penal Code.

At the instigation and on provocative speech of the petitioner, who happens to be Block Secretary of C.P.I.(M), 3040 persons breaking open the main gate intruded into the house of the informant and strewn the household articles. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. He has been falsely implicated in the case. He has not

Patna High Court CR. MISC. No.27655 of 2019(2) dt.30-04-2019 2/2 given any provocative speech or instigated the people. There is no overt act against the petitioner. B.D.O. has reported about not happening of such occurrence at the place of occurrence. Petitioner has no criminal antecedent.

On the other hand, learned APP opposed the bail prayer of the petitioner.

In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., Jhanjharpur (Madhubani) in connection with Madhepur P.S. Case No. 25 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
