1. The present petition has been filed for restoration of a petition bearing MJC No.145 of 2022, which has stood dismissed for default on account of non-compliance of the peremptory order dated 23.02.2024.
2. The learned counsel for the petitioner has submitted that on account of him being out of station for the purposes of treatment of his mother, he could not gain knowledge about the peremptory order dated 23.02.2024, hence the defects could not be removed within the stipulated time frame, however, the same would definitely be removed within a
Patna High Court MJC No.1541 of 2025(2) dt.09-05-2025 2/2 period of four weeks from today, thus a sympathetic view be taken and the aforesaid petition be restored.
3. Having regard to the submission made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and proper to restore the aforesaid petition bearing MJC No.145 of 2022 to its original file, however, subject to removal of the remaining defects pointed out by the Registry within a period of four weeks from today.
4. Accordingly, the present petition stands disposed off on the aforesaid terms.
