JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 22-04-2019 The present petition has been filed for transfer of Matrimonial Case No. 25 of 2016 from the Court of learned Principal Judge, Family Court, Madhubani to the Court of learned Principal Judge, Family Court, Darbhanga.
2. It is submitted that the petitioner is a lady who has come to live with her parents at Darbhanga which is situated at a distance of 40-50 kilometers from Madhubani, as such it would be very difficult to travel to Madhubani in order to defend the matrimonial case filed by the opposite party for dissolution of marriage.
3. None appears on behalf of the opposite party when the matter is called nor any counter affidavit has been filed despite opportunity of hearing being afforded to him.

4. Having heard learned counsel for the petitioner, this Court is not satisfied that any credible ground has been made out for seeking transfer of the matrimonial case from Madhubani to Darbhanga. The mere fact that the petitioner happens to be a lady cannot by itself be a ground to plead that there would be difficulty in traveling a distance of about 40 kilometers to Madhubani. No other ground has been raised for seeking such transfer. 5.
