The petitioner seeks bail in Phulparas P.S. case No.133 of 2018 registered under Sections 147, 148, 149, 341, 323, 504, 506, 307 of the Indian Penal Code and 27 of the Arms Act, pending in the court of A.C.J.M.-IInd, Jhanjharpur, Madhubani.

Allegation is that the accused persons including the petitioner made firing upon the husband of the informant and accused Om Prakash Yadav fired upon the husband of the informant, due to which he sustained fire arm injury. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.02.2019. There is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.32464 of 2019(3) dt.15-07-2019 2/2 petitioner. General and omnibus allegation has been made. Specific allegation is against co-accused Om prakash Yadav, who is alleged to have fired upon the victim causing injury on left arm.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R. The petitioner has got as many as 33 cases pending against him.

Considering the antecedents of the petitioner, I am not inclined to grant bail to the petitioner at this stage. The same is rejected.
