The petitioner apprehends his arrest in a case registered for the offence under Section 272, 273, 34 of the I.P.C. and Section 30(a) of the Bihar Prohibition & Excise Act. 59.15 liters of foreign liquor has been recovered from the hut of the petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the possession of this petitioner. In fact, recovery has been made from co-accused Shekhar Kumar Shah, who was allegedly selling illicit liquor from the hut of this petitioner and petitioner has got no concern with the seized liquor.
