====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section 302 and other allied sections of the Indian Penal Code.

As per the prosecution case, unknown criminals committed murder of father of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and he has been made accused in the case only on suspicion that he was accused in murder of Babloo Kumar, son of the deceased in which petitioner along with others were convicted in the aforesaid case bearing Mohiuddin Nagar Police Station Case No. 54 of 2003. Save and except the same, no other substantive evidence has been collected during

Patna High Court CR. MISC. No.29372 of 2020(9) dt.28-04-2022 2/2 course of investigation to suggest the implication of this petitioner in the present case. Petitioner is in custody since 12.2.2020.

Learned counsel for the State opposes the prayer for bail and submits that during investigation it has come that the petitioner had threatened the deceased to tke revenge once he is released on bail. He next submits that this petitioner along with other accused persons committed murder of the father of the informant. Prayer for bail of similarly situated co-accused Rajeev Kumar Mishra has already been rejected by this Court vide order passed in Cr.Misc.No. 13468/2021.

Considering the nature of accusation and materials surfaced against the petitioner during course of investigation, his prayer for bail is refused.

Let the trial be expedited.
