The petitioner is accused in connection with Raxual P.S. Case No. 173 of 2016 arising out of N.D.P.S. Case No. 44 of 2016 registered under sections 20, 22, 23, 24, 25 of the N.D.P.S. Act pending in the Court of 7th A.D.J., Motihari, East Champaran.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner has got no criminal antecedent. Nothing has been recovered from his possession. He is in custody since 15.08.2016. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that the

Patna High Court CR. MISC. No.28443 of 2019(4) dt.08-07-2019 2/2 alleged seized Heroin was found more than small quantity. Hence, the petitioner does not deserve bail.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.

However, Trial Court is directed to conclude the trial within a period of six months.
