Mr. Sarvdeo Singh, learned counsel for the petitioners seeks permission to withdraw the application with respect to petitioner no. 2, as he has been arrested. The application with respect to petitioner no. 2/Dipak Kumar @ Abhai Kumar stands dismissed as withdrawn.

Patna High Court CR. MISC. No.25698 of 2020(2) dt.14-10-2020 2/3 The petitioner nos. 1, 3 and 4 seek bail in anticipation of their arrest in connection with Maner P.S. Case No. 508 of 2019 dated 15.10.2019 instituted for the offence under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. It has been submitted on behalf of the petitioners that an occurrence took place on the eve of immersion of idol of Goddess Durga, when a scuffle took place between the parties. The accusation of assault is squarely on one Jyoti Kumar, who is not one of the petitioners here. There is counter version of the occurrence as well about which, reference has been given in paragraph -11 of the bail petition.

Considering the nature of accusation against petitioner no. 1/ Anil Kumar Singh @ Anil Ray, petitioner no. 3/ Sunny Kumar @ Sunny Rai and petitioner no. 4 /Raju Kumar, they are directed to be released, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/-
