This application for anticipatory bail arises out of L.N.M.U. P.S. Case No. 98 of 2018 for the offence punishable under Sections 467, 468, 471, 506, 420, 384, 504, 506, 448, 427, 380 and 120B of the Indian Penal Code.
The petitioner is tenant of the informant. From the First Information Report, it transpires that there is dispute between them over payment of rent on regular basis. An eviction suit, filed by the informant, is pending. Allegedly, the petitioner had issued a cheque in favour of the informant, which stood dishonoured on being presented in the Bank. I have heard learned counsel appearing on behalf of the petitioner and the informant.
Considering the nature of dispute, a case for
Patna High Court CR. MISC. No.29731 of 2019(2) dt.07-05-2019 2/2 anticipatory bail is made out, particularly in view of the stand taken on behalf of the petitioner that he shall pay to the informant the cheque amount, which has stood dishonoured, before appearing before the Court for furnishing bail bonds, if the petitioner is granted the privilege of anticipatory bail. In view of the above, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga, in L.N.M.U. P.S. Case No. 98 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
