Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B)/34 of Indian Penal Code.

Petitioner is husband of the victim of dowry death. He is in custody since 23.06.2018.

In the past, prayer for bail to the petitioner was refused on 01.04.2019 with liberty to renew the prayer after one year, if no substantive progress is made in the trial. The report of the learned Trial Judge reveals that charges were framed on 03.11.2020 and thereafter only three prosecution witnesses have been examined.

Considering the period already undergone by the petitioner as undertrial prisoner and undertaking of the

No.25350 of 2020(4) dt.05-02-2021 2/2 petitioner to cooperate with the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.564 of 2019, 219 of 2019 arising out of Tekari Police Station Case No.222 of 2018 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
