Petitioner apprehends her arrest in G.O. Excise Case No.799 of 2018, arising out of Sadar (Bhalpatti O.P.) P.S. Case No.363 of 2018, registered for the offences allegedly committed by the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act.
The police got information that in the southern side of village Majhariya, country made liquor was being prepared. The police went there, seized country made liquor but nobody was found present there. The informant got information that Arun Paswan, Rekha Devi, Meera Devi and Binod Paswan, all residents of village Majhariya, P.S. Sadar, O.P. Bhalpatti were preparing liquor.
Patna High Court CR. MISC. No.27903 of 2019(2) dt.29-04-2019 2/2 It appears that none was found present at the site of recovery and the informant did not disclose the name of the person who disclosed about the participation of the petitioner in preparation of liquor. Petitioner is a lady.
Considering the facts aforesaid, let petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-Vth-cum-Special Judge (Excise Act), Darbhanga in connection with G.O. Excise Case No.799 of 2018, arising out of Sadar (Bhalpatti O.P.) P.S. Case No.363 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) S.KUMAR/- U T
