====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-04-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The petitioner is in custody in connection with Bhore P.S. Case No. 389 of 2018 for the offences under Sections 307 of the Indian Penal Code and Section 27/35 of Arms Act. Learned counsel for the petitioner submits that the petitioner is a contractor he was threatened by the miscreant for dire consequences in case of failure to pay Rs.5/- lacs as extortion money. He further submits that the petitioner in exercise of right to private defence has used fire arms and as such petitioner is entitled to privilege of bail. Considering the fact that place of occurrence is work place of the petitioner, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing

Patna High Court CR. MISC. No.27642 of 2019(2) dt.26-04-2019 2/2 bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Gopalganj in connection with Bhore P.S. Case No. 389 of 2018.
