JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-11-2017 It is the case of the petitioner that he had appeared for vocational course examination, held by National Institute of Open Schooling, Noida. In the admit card his name was wrongly mentioned as Ratan Kumar Chhaiyal in place of Md. Izhar. It is further the case of the petitioner that when he pointed out, his name was corrected. In support of this plea, Annexure-2 has been brought on record. Annexure-2 indicates that correction, if any, was not made by any competent authority. There is cross mark against the wrongly mentioned name i.e. Ratan Kumar Chhaiyal and thereafter Md. Izhar has been inserted. It is not indicative of the fact that the decision to change the entry

Patna High Court CWJC No.16998 of 2017 (2) dt.23-11-2017 2/2 of name was taken by the competent authority. The petitioner is aggrieved since in the marks statement of the said examination, name of the said Ratan Kumar Chhaiyal is figured. The Court, in the writ proceedings, cannot go into such aspects. The petitioner has represented before the Director, National Institute of Open Schooling, Noida, U.P. on 16.03.2012. The petitioner shall be at liberty to approach the said National Institute of Open Schooling by filing representation afresh and, if does so within a period of two weeks from today, the National Institute of Open Schooling shall be required to take appropriate decision on the petitioner's claim within a period of two months.
