JUSTICE ARVIND SRIVASTAVA ORAL ORDER 25-08-2021 This application is filed for modification of the order dated 22.01.2020 passed in Cr. Revision No. 1065 of 2019 as well as the order dated 17.02.2021 passed in Cr. Misc. No. 8139 of 2021, whereby the vehicle of the petitioner was released on various terms and conditions, including furnishing of one surety along with Bank Guarantee.

Submission of learned counsel for the petitioner is that petitioner is unable to deposit Bank Guarantee. The vehicle is lying upon the open place since 23.04.2019. Further, he submits that he is ready to submit sureties for release of the vehicle in place of the Bank Guarantee.

Patna High Court CR. MISC. No.40479 of 2021(6) dt.25-08-2021 2/2 Considering the reasons as stated in the modification application and the submissions made on behalf the petitioner, the modification application is allowed.

Accordingly, the order dated 22.01.2020 passed in Cr. Revision No. 1065 of 2019 as well as order dated 17.02.2021 passed in Cr. Misc. No. 8139 of 2021 stand modified to the extent that in place of Bank Guarantee, petitioner is allowed to submit sufficient surety.

The modification application is disposed of.
