2.The petitioner is named in the F.I.R. and apprehending his arrest in connection with Kotwa P.S. Case No. 47 of 2024 registered for the offences punishable under Sections 341, 323, 504, 506, 498A of IPC.
3. Allegation against petitioner is to commit mental and physical cruelty upon complainant/ OP No. 2 due to non fulfillment of demand of dowry as raised for cash of 3 lakh
4. It is submitted by learned counsel appearing on behalf of the petitioner that informant is habitual to lodge such complaint against petitioner and his family members. It
Patna High Court CR. MISC. No.29754 of 2026(4) dt.27-07-2026 2/3 is pointed out that prior to present FIR, one complaint case was lodged against petitioner which was registered as complaint case no. 105 of 2024 where considering all such aspect ld. Trial court granted anticipatory bail to the petitioner vide order dated 02.08.2025 as passed in ABP No. 3823 of 2025 by the court of learned Sessions Judge, East Champaran, Motihari. It is submitted that when petitioner was granted anticipatory bail in complaint case on 07.02.2026 the present FIR was lodged for the occurrence dated 09.02.2024. It is submitted that O.P. No. 2 is under habit to remain outside home even at odd hours in night and when said habit was checked/ opposed by petitioner the present case was lodged. It is submitted that one case was lodged by O.P. No.
2 against one Raj Kumar for the offence punishable under Section 64 of BNS for which Mahila P.S. Case No. 91 of 2025 was lodged. It is submitted that O.P. No. 2 admitted thereof that she is social media influencer and remain outside oftenly for making reels. Petitioner claimed clean antecedent.
5.Learned APP opposes the prayer of bail.

6. In view of aforesaid factual submission and by taking note of fact as O.P. No. 2/ wife is prima-facie appears to lodge criminal case against her husband i.e., petitioner frequently, where present case was lodged just after two days of granting anticipatory bail in complaint case along with same allegations, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM X, East champaran, Motihari /concerned Court, where the case is pending in connection with Kotwa P.S. Case No. 47 of 2024, subject to the conditions as laid down under Section 482(2) of BNSS. (Chandra Shekhar Jha, J) Sudha/- U T
