JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-01-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek pre-arrest bail in connection with Parwatta P. S. Case No. 194 of 2016 registered under Sections 364-A, 365, 323 and 379 of the Indian Penal Code. Regard being had to the submissions made by the learned counsel for the petitioners that the date of occurrence is 21.02.2016 and a complaint was filed after four days on 25.02.2016, which was subsequently referred to the police under Section 156(3) of the Cr.P.C. for investigation pursuant to which Parwatta P. S. Case No. 194 of 2016 was instituted
Patna High Court Cr.Misc. No.490 of 2018 (2) dt.12-01-2018 2/2 after six months of the occurrence on 20.08.2016 and even in the FIR, no allegation has been made against the petitioner which would attract the ingredients of the offence under Section 364-A of the Indian Penal Code, these two ladies are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-1, Khagaria in Parwatta P. S. Case No. 194 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
