============================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-10-2020 Heard Mr. Satish Kumar Singh, learned counsel for the petitioner and Mr. Ram Priya Sharan Singh, learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Sourbazar P.S. Case No. 494 of 2019 dated 25.12.2019 instituted for the offence under Sections 341, 323, 324, 307, 384, 354, 379, 504, 506 and 34 of the Indian Penal Code.

The informant has alleged in the First Information

Patna High Court CR. MISC. No.25709 of 2020(2) dt.14-10-2020 2/3 Report that because of his not having sold the adjacent land to the accused persons, an occurrence took place in which many other named accused persons assaulted the informant. So far as the petitioners are concerned, they are said to have shot arrows which hit the cousin of the informant leading to injuries in his eyes.

Learned counsel for the petitioners has drawn the attention of this Court to the fact that the cousin of the informant, who is said to have been injured at the hands of the petitioners has received simple injuries caused by hard and blunt substance. The injury report of Raj Kumar Yadav, the person concerned is at page -22 of the brief. Regard being had to the nature of accusation against the petitioners and the injury report about which reference has been made and taking into account the fact that there is counter version of the occurrence and the petitioners are persons of clean antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this

Patna High Court CR. MISC. No.25709 of 2020(2) dt.14-10-2020 3/3 order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Sourbazar P.S. Case No. 494 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
