The petitioner apprehends his arrest in Majhaulia P.S. Case No.347 of 2017 registered under Sections 409 and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that petitioner was the headmaster of Prathmik School Bakuliya Tola. He was entrusted for construction of school building on estimated cost of Rs.7,92,000/-. The petitioner got the school building constructed and submitted certificate on completion of construction. On 28.02.2016, F.I.R. is of course lodged against the petitioner also but the informant did not disclose anywhere that the

Patna High Court Cr.Misc. No.345 of 2018 (2) dt.16-01-2018 petitioner received how much amount. The learned counsel for the petitioner further submits that the petitioner received Rs.7,92,000 and did the construction work of the school building and thereafter filed completion certificate.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Majhaulia P.S. Case No.347 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
