JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Pandaul P.S. Case No. 147 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 337, 338, 307, 427, 114, 332, 333, 353 and 379 of the Indian Penal Code.

Petitioner is not named in the FIR and there is allegation that petitioner and others have damaged the hospital property and also attacked on the police party. Submission of learned counsel for the petitioner is that due to death of a lady patient in the clinic of the informant such occurrence took place and nothing specific has been attributed against him and he has no criminal antecedent. Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.35680 of 2019(3) dt.17-08-2019 2/2 petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani/Incharge successor court, in connection with Pandaul P.S. Case No. 147 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
