The petitioner seeks bail in a case registered under Sections 147, 148, 149, 353, 307, 386 of the Indian Penal Code and 25(1-b)a/26/27/35 of the Arms Act and Section-17 of C.L.A. Act.

The prosecution case in short is that when the informant with police personnel reached at the place of occurrene, 40-50 persons were seen assembled with weapons. Some were hidden in bush. Having seen the police, they started firing. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 21-02-2019. Charge

Patna High Court CR. MISC. No.30737 of 2019(3) dt.20-06-2019 2/2 sheet has already been submitted. The petitioner has been falsely implicated in the present case. General and omnibus allegation has been made against the petitioner. No specific allegation has been made against the petitioner. The other coaccused with similar allegation has been granted bail by coordinate bench of this court vide order dated 28-06-2012 passed in Cr. Misc. No. 10332 of 2012.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri, Rohtas in connection with Akodhigola P.S. Case No. 76 of 2011.
