1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. The petitioner seeks regular bail in connection with Sikarhatta Police Station Case No. 04 of 2020, dated 01.02.2020, registered for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. This is the second attempt on behalf of the petitioner for grant of regular bail. Earlier, the prayer for regular bail of the petitioner was rejected by this Court, vide order, dated 26.04.2022, passed in Criminal Misc. No. 41160 of 2021.
4. Considering the fact that the petitioner is the main assailant and the earlier prayer for bail of the petitioner was dismissed on merit, I am not inclined to grant bail to
Patna High Court CR. MISC. No.44930 of 2023(3) dt.25-08-2023 2/2 the petitioner, at this stage.
5. This application is, accordingly, dismissed.
6. However, the petitioner may renew his prayer for bail after six months from today, if the trial does not show any progress.
