The petitioner is in custody in connection with Sahebganj P.S. Case No.70 of 2019 for the offences under Sections 272, 273, 120-B of the Indian Penal Code and Sections 30(a) (g), 33, 34(b), 35(a), 36, 41(a)(2) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that at the relevant time the petitioner was in custody and nothing was recovered from his possession and as such he was not involved in the commission of offence. He further submits that petitioner is not connected with the trade of liquor and he is in custody since 26.03.2019. He further submits that in the instant case total 1293 liters liquor was seized.
