JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-09-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Session Trial No. 576 of 2001 arising out of Raghopur P.S. Case No. 72 of 2000 for the offences 147, 148, 149, 427, 452, 323, 307 and 380 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner would submit that the allegation against the petitioner is that he along with other accused persons entered into the house of the complainant and he assaulted the father of the complainant by means of lathi and took away tin-box containing cash and jewelry. On remand, petitioner is in custody since 29.06.2020.

No.25457 of 2020(2) dt.29-09-2020 2/2 Considering the fact that the petitioner is 60 years old and on remand, he is in custody since 29.06.2020, the Court is inclined to grant bail to him subject to the condition that the petitioner has to deposit Rs. 25,000/- in cash. On depositing the amount of Rs.25,000/-, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI, Vaishali at Hajipur in connection with Session Trial No. 576 of 2001 arising out of Raghopur P.S. Case No. 72 of 2000. Deposit of Rs.25,000/- (Rupees twenty five thousand) shall abide by final outcome of the instant criminal case. (Anil Kumar Upadhyay, J) BT/- U T
