====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-01-2021 Heard learned counsel for the petitioner. No one appears on behalf of the State although the name of the Advocate General is appearing in the cause list. Petitioner is in custody in connection with Gwalpara (Arrar) P.S. Case No. 216 of 2019 for the offence under sections 147, 148, 149, 341, 323, 307, 504 506 of the Indian Penal Code and 27 of the Arms Act.
Learned counsel for the petitioner submits that petitioner is in custody since 23.4.2020. He further submits that there is delay of 8 days in lodging the FIR. The alleged occurrence took place on 20.11.2012 whereas FIR was lodged on 28.11.2010.
Learned counsel submits that other similarly circumstanced co-accused have been granted anticipatory bail

Considering the fact that there is delay of 8 days in lodging the FIR, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Udakishunganj, Madhepura, in connection with Gwalpara (Arrar) P.S. Case No. 216 of 2019.
