Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
Liquor was recovered from a truck and the petitioner, who was driver of the truck, was arrested at the spot. Petitioner is in custody since 14.11.2019.
Earlier prayer of the petitioner for bail was refused by a Coordinate Bench of this Court by order dated 04.02.2020 in Cr. Misc. No. 6162 of 2020 with liberty to renew the prayer if
Patna High Court CR. MISC. No.29605 of 2020(2) dt.23-11-2020 2/2 the trial is not concluded within a period of six months. Submission is that the trial is still pending. Considering the period already undergone by the petitioner and no material to substantiate that he is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ujiyarpur Police Station Case No. 270 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
