JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Jamui P.S. Case No. 43 of 2015 registered for the offence punishable under Sections 414/34 of the Indian Penal Code.

As per FIR allegation is of recovery of stolen articles from the house of co-accused Manju Devi and petitioner is also named in the FIR.

Submission of learned counsel for the petitioner is that there is nothing against the petitioner except that he was also present there and he is suffering from mental disease and in support of that he has annexed Annexure-2 to this petition and he has also no criminal antecedent.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.31889 of 2019(4) dt.30-09-2019 2/2 petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No. 43 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
