1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Itarhi Police Station Case No. 236 of 2022, dated 06.08.2022, disclosing offences under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. That the prosecution case, in brief, is that on 05.08.2022 while on patrolling duty the police on the basis of secret information reached at village Lodhas. On seeing police party, two persons started fleeing away, on chase, one person, namely, Nemnath Singh, was apprehended while another person managed to flee away. Upon search of the Swift Dezire car, bearing registration no. RJ14-TE-5110,

Patna High Court CR. MISC. No.29273 of 2026(2) dt.06-05-2026 2/3 as well as the house of the co-accused, total 54.2 litres of illicit foreign liquor.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case merely because he happens to be the registered owner of the said vehicle. He next submits that the vehicle, from where illicit liquor has been recovered, was borrowed by Nem Nath Singh, who is maternal uncle of petitioner's wife, for the purpose of his daughter's marriage. He further submits that the petitioner had no knowledge about illicit liquor being kept therein. The petitioner has got no criminal antecedent.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner has been made accused merely because he happens to be the registered owner of the motorcycle, which was borrowed by his relative for his daughter's marriage, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be
