JUSTICE PURNENDU SINGH ORAL ORDER 02-05-2024 Heard Mr. Santosh Kumar, learned counsel appearing on behalf of the petitioner and Mr. Ajit Kumar Sinha, learned counsel along with Ms. Dilkash Khan, learned counsel appearing on behalf of the Bank.

2. As prayed for, learned counsel appearing on behalf of the petitioner is permitted to make necessary correction in the cause title of the present writ petition in course of the day, as a consequence of the fact that Allahabad Bank has merged with Indian Bank.

3. Learned counsel appearing on behalf of the petitioner submitted that the order dated 19.09.2011 is non-

Patna High Court CWJC No.12867 of 2012(4) dt.02-05-2024 2/3 speaking order so far as entitlement of the deceased employee, namely, late M. R. Kumar, Ex-Chief Manager, Regional Office, Kanpur is concerned. The said employee was awarded a major punishment of 'reduction in basic pay by two stages in the time scale of pay in SMG Scale-IV for a period of two years with cumulative effect'. The claim of the petitioner is that the same will not disentitle him from pension as no dismissal order was passed in respect of the deceased employee (husband of the petitioner). In this background, learned counsel submitted that the petitioner is entitled for family pension and seeks to file a detailed representation before the Managing Director, Indian Bank - respondent no.1 through the General Manager, Personnel Administration, Indian Bank - respondent no.2 and the Deputy General Manager, Indian Bank - respondent no.3 for redressal of his grievance.

Considering the aforesaid submission made on behalf of the petitioner, the petitioner, if so advised, may file a detailed representation before the Managing Director, Indian Bank - respondent no.1 through the General Manager, Personnel Administration, Indian Bank - respondent no.2 and Deputy General Manager, Indian Bank - respondent no.3. The aforesaid respondents having noted specifically the fact that the
