Petitioner apprehends arrest in connection with Bahadurganj P.S. Case No. 272 of 2018 registered for the offence punishable under sections 370, 372, 376, 120B/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report. He has been implicated in this case on basis of the confessional statement of the co-accused. The Victim in her statement under sec tion 164 Cr.P.C. has not stated anything against this petitioner. During investigation also, no material has come showing complicity of this petitioner in the alleged

Patna High Court CR. MISC. No.28502 of 2019(2) dt.02-05-2019 2/2 crime. Moreover, F.I.R. named accused has been granted anticipatory bail by a co-ordinate Bench of this Court vide Annexure-3. Petitioner is a lady having no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge I-cumSpecial Judge, Kishanganj in connection with Bahadurganj P.S. Case No. 272 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
