The petitioner seeks bail in Bairgania P.S. Case No. 59/2019, instituted for offence under Section(s) 272, 273 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that on getting secret information, informant along with other police personnel came at Nandbara Chawk and saw five persons coming with bags on four bicycles. They tried to run away, seeing the police party but on chase one person was caught who disclosed his name as petitioner. The police recovered total 423 litres of Nepali liquor from those four bicycles, kept in bags.

Learned counsel for the petitioner has submitted that

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IInd-cumSpecial Judge, Excise Act, Sitamarhi, in connection with Bairgania P.S. Case No. 59/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
